Welcome to NEXPEDE EXPRESS. By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.
1. Acceptance of Terms
By creating an account, accessing, or using NEXPEDE EXPRESS services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
2. Description of Services
NEXPEDE EXPRESS provides:
- Dispatch Services: On-demand package delivery connecting senders with independent delivery riders in Lagos, Nigeria, USA, UK, and Canada
- Marketplace: E-commerce platform connecting buyers with local sellers (delivery currently available in Lagos only)
- Real-time Tracking: Live tracking of deliveries and order status
3. User Accounts
Account Registration
- You must be at least 18 years old to create an account
- You must provide accurate and complete information
- You are responsible for maintaining account security
- One account per person is permitted
Account Types
- Buyers: Can send packages and purchase from marketplace
- Sellers: Can list products and manage a shop on the marketplace
- Riders: Independent contractors who deliver packages
4. Dispatch Services Terms
Package Requirements
- Packages must not exceed size and weight limits
- Prohibited items include: illegal goods, hazardous materials, weapons, drugs, perishables without proper packaging
- Accurate description of package contents is required
Delivery Terms
- Delivery times are estimates and not guaranteed
- Recipients must be available to receive packages
- Proof of delivery (OTP or photo) is required
- Failed deliveries due to recipient unavailability may incur additional fees
5. Marketplace Terms
For Buyers
- All sales are final unless otherwise stated by seller
- Review product descriptions carefully before purchase
- Delivery is currently available only within Lagos, Nigeria
- Disputes must be raised within 48 hours of delivery
For Sellers
- Sellers must provide accurate product descriptions and images
- Products must comply with Nigerian consumer protection laws
- Sellers are responsible for product quality and packaging
- Commission rates apply to all marketplace sales
- Payouts are processed after successful delivery confirmation
6. Rider Terms
- Riders are independent contractors, not employees
- Riders must maintain valid documentation and insurance
- Assigned deliveries must be completed; rejection is not permitted
- Riders earn a percentage of delivery fees (default 90%)
- Payout requests are processed weekly
- Riders must maintain professional conduct at all times
7. Payments and Fees
- All payments are processed through secure payment gateways
- Nigerian transactions: Paystack or Flutterwave (NGN)
- International transactions: Stripe (USD, GBP, CAD)
- Prices are inclusive of all applicable taxes
- Refunds are processed according to our Refund Policy
- Wallet balance can be used for future transactions
8. Prohibited Conduct
Users must not:
- Violate any applicable laws or regulations
- Provide false or misleading information
- Engage in fraudulent transactions
- Harass or abuse other users, riders, or sellers
- Attempt to manipulate pricing or ratings
- Use the platform for unauthorized commercial purposes
- Interfere with platform security or functionality
- Create multiple accounts to circumvent restrictions
9. Disputes and Resolution
- Disputes can be raised through the app within 48 hours
- Our support team will investigate all disputes
- Urgent disputes are prioritized
- Resolutions may include refunds, credits, or account actions
- NEXPEDE EXPRESS decision on disputes is final
10. Liability Limitations
NEXPEDE EXPRESS is not liable for:
- Damages to packages caused by improper packaging by sender
- Delays due to traffic, weather, or unforeseen circumstances
- Quality issues with products purchased from sellers
- Actions of independent contractor riders beyond our control
- Losses exceeding the value of the transaction
Our maximum liability is limited to the amount paid for the specific service in question.
11. Intellectual Property
All content, trademarks, logos, and intellectual property on the NEXPEDE EXPRESS platform are owned by or licensed to us. Users may not copy, modify, distribute, or create derivative works without our written permission.
12. Account Termination
We reserve the right to suspend or terminate accounts for:
- Violation of these Terms of Service
- Fraudulent or illegal activity
- Repeated policy violations
- At our discretion with reasonable notice
Users may delete their account at any time through the app settings. Outstanding balances must be settled before account closure.
13. Changes to Terms
We may update these Terms of Service at any time. Material changes will be communicated via email or in-app notification. Continued use of our services after changes constitutes acceptance of the modified terms.
14. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos, Nigeria, unless international arbitration is mutually agreed upon.
